By two votes, on January 31, 2006 The House of Representatives passed the new regulations concerning Medicaid. Under the new rules the “lookback” period will be five years instead of three. This will impact the transfer of assets. Any assets that were transferred within the five years could lead to a penalty period. Which leads us to another change, the penalty period will start when you enter the nursing facility not when the transfer took place. There is a way to bypass all of this trouble by planning early. If planning for your future has been on your mind and you have been putting it off, DON’T there is too much to lose.
